Welcome to Acculyst Tech, a division of Acculyst Accounting Pty Ltd (“we”, “our”, “us”). By accessing or using this website (Acculyst.com.au) and our related services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

Acculyst Tech provides digital solutions including company registration, ABN setup, mobile app development, web development, web app development, AI solutions, and related technology services for Australian businesses.

These Terms outline how you may use our website and services, and your rights and responsibilities when engaging with us.

By visiting our site, submitting an enquiry, or purchasing a service, you confirm that you are at least 18 years old and have the authority to enter into a binding contract with Acculyst Accounting Pty Ltd.

3. Services

We aim to deliver high-quality, efficient, and transparent services. All work is performed in good faith based on the information provided by you.

Unless otherwise stated, all setup or upfront payments made to Acculyst Tech are non-refundable. This includes payments for company registration, digital setup, and development projects.

4. Pricing and Payments

  • All prices are quoted in Australian Dollars (AUD) and include GST where applicable.
  • Payment is due prior to commencement of work unless otherwise agreed in writing.
  • Invoices are payable via the methods stated on the invoice (bank transfer, card, or online payment).
  • Failure to pay on time may result in delayed delivery or suspension of ongoing services.

5. Intellectual Property

All content, code, designs, and materials created by Acculyst Tech remain our intellectual property until full payment is received.

After full payment, you are granted a non-exclusive, non-transferable license to use the delivered work for your business purposes. You may not resell, reproduce, or distribute our work without written consent.

6. User Responsibilities

You agree to:

  • Provide accurate and complete information when requested;
  • Use our website and services only for lawful purposes;
  • Not attempt to hack, modify, or disrupt our systems or servers;
  • Ensure all content you provide (logos, text, data) is owned or licensed by you.

7. Project Delivery

Delivery timelines are based on mutual agreement and commence once all required information, content, and payment have been received.

Minor adjustments may occur depending on project scope, client feedback, or third-party dependencies. We will always communicate delays transparently.

8. Revisions and Support

Each project includes a limited number of revisions as outlined in your project proposal or invoice. Additional changes beyond this scope may incur extra charges.

Technical support after project delivery is available through our maintenance plans or on a per-task basis.

9. Limitation of Liability

While we take every care in delivering reliable and secure services, Acculyst Tech shall not be liable for:

  • Any loss of data, revenue, or profits arising from the use of our services;
  • Website or application downtime caused by third-party providers, hosting, or user misuse;
  • Indirect, incidental, or consequential damages of any kind.

Our liability is limited to the total amount paid for the specific service in question.

10. Third-Party Tools and Integrations

Our services may integrate with third-party platforms such as hosting providers, payment gateways, or APIs. While we ensure compatibility, we are not responsible for changes, errors, or downtime caused by these providers.

11. Privacy and Data Protection

We handle all personal data in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. By using our website, you consent to the collection and use of data as outlined there.

12. Termination

We reserve the right to suspend or terminate any service immediately if you breach these Terms, provide false information, or misuse our services.

In such cases, no refunds will be issued for payments already made.

13. Governing Law

These Terms and any disputes arising under them are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland.
