These terms apply when you use the Acculyst Tech website (tech.acculyst.com.au). The website is operated by Acculyst Accounting Pty Ltd (ABN 15 686 696 908) trading as Acculyst Tech.

By using this website, you agree to these terms. If you do not agree, please do not use the site.

Using the website

You may use this website for lawful purposes only. You agree not to:

• try to gain unauthorised access to the site, our systems or other users’ information;
• interfere with the site’s operation, including by sending malicious code or excessive automated requests;
• copy or scrape the site’s content at scale without our written permission.

We work to keep the information on this website accurate and current. It is general information and not advice tailored to your business.

Prices, features and plan inclusions shown on this site describe our standard offers. Your final scope, price and terms are confirmed in the written plan we give you. Examples and concept work on this site are labelled as such and are not a promise of a specific result.

We do not guarantee search rankings, traffic, sales, app-store approval or any other business outcome.

Managed plans and services

Our services are provided through managed monthly plans. Before any work starts, we give you a written plan that sets out:

• what is included and what is not;
• the monthly fee and any setup fee;
• the minimum term and how you can end the plan;
• how and when you are invoiced;
• what we need from you, and the expected timeline.

Prices are in Australian dollars. How GST applies is confirmed in your written plan. Work outside the agreed scope is quoted and agreed with you before we start.

We can only deliver on time if you give us the content, access and approvals we ask for. Delays on your side can move the timeline.

Your content and our materials

You keep ownership of the content you give us, such as your text, images, logos and brand assets. You confirm that you have the right to use that content and that it does not infringe anyone else’s rights. You give us permission to use it to deliver and manage your project.

We keep ownership of our own pre-existing tools, methods and materials. Ownership and licensing of the specific things we create for you is set out in your written plan.

Unless you tell us otherwise, we may describe the project as a piece of our work. We will not publish confidential information or results you have not approved.

Third-party services

Your project may depend on services we do not control, such as domain registrars, booking providers, email providers and social platforms. These services run under their own terms and can change their features, pricing or rules. We are not responsible for outages or changes made by those providers, though we will help you respond to them as part of your plan.

Warranties and liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other laws that cannot be excluded.

Subject to that, and to the extent the law allows: this website is provided “as is”; we are not liable for indirect or consequential loss, such as lost profit or lost opportunity; and our total liability for a claim relating to this website is limited to resupplying the information or, where the law allows, the cost of doing so.

Liability for paid services is set out in your written plan.

Privacy

How we collect and use personal information is explained in our Privacy Policy.

Changes to these terms

We may update these terms from time to time. The latest version is always on this page, and the “last updated” date at the top shows when it last changed. Continuing to use the site after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
